1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legal agreement between you and FLYDER LLC ("Company," "we," "our," or "us"). By accessing, visiting, or using the FLYDER platform, website, and services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you are not authorized to use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service following changes constitutes your acceptance of the modified Terms.

2. Service Description

FLYDER provides an AI agent platform that enables users to develop, deploy, and manage autonomous AI agents for business automation and workflow orchestration. Our Service includes:

We reserve the right to investigate violations and take appropriate action, including account suspension or termination.

5. Intellectual Property Rights

All content, software, features, and materials of the FLYDER Service are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

Any content you create using the Service ("User Content") remains your property, but you grant us a license to use, reproduce, and distribute such content to provide and improve the Service.

You may not copy, modify, reproduce, distribute, or reverse-engineer any part of the Service without explicit permission.

6. Pricing and Billing

Pricing for our Service is detailed on our pricing page. By subscribing, you agree to pay the applicable fees according to your selected plan. We may change pricing with 30 days' notice.

• •All fees are exclusive of applicable taxes, which you are responsible for paying
• •Cancellation is allowed at any time; refunds follow our refund policy
• •Overages beyond plan limits will be billed separately
• •Unpaid accounts may be suspended until payment is received

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLYDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO FLYDER IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THIS MAY NOT APPLY TO YOU.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. FLYDER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or malicious code. Your use of the Service is at your sole risk.

9. Indemnification

You agree to indemnify and hold harmless FLYDER, its officers, directors, employees, and agents from any claims, damages, or costs arising from your use of the Service, violation of these Terms, or violation of any third-party rights. This includes reasonable attorney's fees and court costs.

10. Termination

We may terminate or suspend your account immediately, without notice, if you violate these Terms or engage in harmful activities. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting support. Data deletion follows our Privacy Policy timelines.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates, without regard to conflicts of law principles. Any legal action or proceeding must be brought exclusively in the courts located in Dubai, UAE.

You consent to the exclusive jurisdiction and venue of these courts and waive any objection based on inconvenient forum.

12. Dispute Resolution

Before initiating legal proceedings, parties agree to attempt informal resolution by contacting support at support@flyder.ae. If informal resolution fails, disputes shall be resolved through binding arbitration or litigation in the UAE courts as outlined above.
